Welcome to MyWishlist. These Terms of Use govern access to and use of the website www.mywishlist.co, the dashboard at app.mywishlist.co, and the MyWishlist mobile application for iOS and Android (together, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree with any provision, please do not use the Service. The Service is operated from Brazil and is governed by Brazilian law.
1. Acceptance of Terms and Legal Capacity
By creating an account and using MyWishlist, you confirm that you have full legal capacity to contract (in Brazil, this generally means being 18 years old or older or being legally emancipated) or that you are duly assisted by a parent or legal guardian. Minors between 12 and 18 years old may only use the Service with the specific consent of a parent or legal guardian.

3. Service Description
MyWishlist is a multilingual platform that allows registered users to create, manage, and share gift lists for different occasions (weddings, baby showers, birthdays, housewarmings, and more). The Service includes: • Creating and personalizing lists on www.mywishlist.co, app.mywishlist.co, and the mobile app • Sharing through unique public links • A reservation system for guests to claim gifts • Exclusively for users registered in Brazil: cash gifts via shares (PIX and credit card), as described in Section 8 • Transforming product links into affiliate links, as described in Section 7 The core service of creating and sharing lists is free. Specific features, such as cash gifts, may involve fees that are disclosed before purchase.
4. User Account
To use the Service you must create an account with truthful, accurate, up-to-date, and complete information. You are responsible for: • Keeping your password and login credentials confidential • All activity carried out through your account • Promptly notifying us of any unauthorized use at contato@mywishlist.co Creating accounts with false data, on behalf of third parties without authorization, or by automated means (bots) is prohibited. We may request identity verification when there are signs of fraud.
5. User Content
You retain ownership of all content you add to the Service (descriptions, images, links, messages). By publishing content, you grant MyWishlist a non-exclusive, royalty-free, worldwide license to store, process, display, and distribute that content strictly as needed to operate the Service, including for visitors of your lists. You represent that you own or are authorized to use all content you publish, including image and text rights. Content identified as unlawful, offensive, fraudulent, or infringing third-party rights will be removed, as provided by the Brazilian Internet Framework (Marco Civil da Internet — Law No. 12,965/2014).
6. User Conduct
You agree not to use the Service to: • Post unlawful, defamatory, obscene, discriminatory, or fraudulent content • Infringe intellectual property or image rights of third parties • Send spam, malware, viruses, or malicious code • Access or attempt to access other users' accounts or data without authorization • Reverse engineer, scrape, or attack the Service • Conduct money laundering or financing of illegal activities (in particular through the cash gifts feature) • Use the Service for unauthorized commercial purposes Violating these rules may result in content removal, suspension or termination of your account, and reporting to the competent authorities where applicable.
7. External Links and Affiliate Programs
MyWishlist transforms product links posted by users into affiliate links from partner platforms (such as Amazon, Mercado Livre, Shopee, and Magazine Luiza). When those links are clicked, they may generate a commission for MyWishlist at no additional cost to the buyer or the list owner. This commission helps keep the Service free. We have no control over the content, prices, availability, payment methods, delivery, or policies of external websites. Every purchase is made directly with the chosen retailer, under your sole responsibility.
8. Cash Gifts (Brazil Only)
The Cash Gifts feature is available exclusively to users whose account country is Brazil. Through this feature, the list owner can split a gift into shares and receive financial contributions from guests. • Payment processing: handled by Pagar.me Pagamentos S.A. (a sub-acquirer regulated by the Central Bank of Brazil), responsible for capture, anti-fraud, and settlement of payments via PIX and credit card. • Minimum share: R$ 50.00 per contribution. • Service fee: starting at 4.99% of the contribution amount, paid by the contributing guest (not by the list owner) and disclosed before payment confirmation. • Availability and withdrawals: PIX contributions become available for withdrawal instantly; credit card within up to 32 calendar days, in line with Pagar.me settlement rules and the relevant payment scheme. • Refunds: PIX contributions may be refunded upon request by the guest within 7 calendar days of payment confirmation, under article 49 of the Brazilian Consumer Protection Code (cooling-off period). Credit card contributions follow the rules of the card network/issuer. Once the list owner has withdrawn the funds, refunds depend on agreement between the parties. • Liability: MyWishlist acts as a technology facilitator between the list owner and the guest. We are not a party to the personal relationship between them and are not responsible for how the list owner uses the funds after withdrawal. • Taxes: the list owner is solely responsible for any tax obligations arising from the funds received.
9. Intellectual Property
All rights in the name, brand, logo, layout, source code, databases, texts, images, and other elements of the Service belong to Grace Labs Tecnologia LTDA or its licensors and are protected by Brazilian Law No. 9,610/1998 (Copyright), Law No. 9,279/1996 (Industrial Property), and international treaties. Reproduction, distribution, or modification without express authorization is prohibited, except for normal use of the Service.
10. Privacy and Data Protection
The processing of your personal data is governed by our Privacy Policy, in compliance with Brazilian Law No. 13,709/2018 (LGPD — General Data Protection Law) and Law No. 12,965/2014 (Marco Civil da Internet). We recommend reading the Privacy Policy in full before using the Service.
11. Service Modifications
We may evolve, modify, suspend, or discontinue features of the Service at any time in order to improve user experience, ensure security, or comply with legal obligations. For material changes that affect users' rights, we will provide reasonable advance notice by email or in-Service notice, except where there is an immediate security risk or legal/regulatory requirement.
12. Limitation of Liability
MyWishlist uses its best efforts to keep the Service available, secure, and functional. Subject to the limitations of applicable law, we are not liable for: • Temporary unavailability due to maintenance, updates, internet instability, third-party provider failures, or force majeure • Content posted by users or external sites linked through affiliate links • The physical delivery of gifts purchased by guests on third-party websites • Acts attributable solely to the user or third parties (fraud, credential misuse) Nothing in this clause limits consumer rights guaranteed by Brazilian law (Law No. 8,078/1990) or our liability for willful misconduct or gross negligence.
13. Suspension and Account Termination
You may close your account at any time through the settings at app.mywishlist.co or in the mobile app. We may suspend or close your account in the following situations: • Violation of these Terms or applicable law • Reasonable suspicion of fraud, illegal activity, or risk to the security of the Service • Court order or requirement from a competent authority Except in cases of fraud or serious risk, we will provide a reasonable period for remediation or response before taking definitive measures. Closing your account does not release you from pending obligations (for example, ongoing refunds).
14. Changes to These Terms
We may update these Terms of Use from time to time to reflect changes in the Service, the law, or market practices. Material changes will be communicated with at least 30 (thirty) days' notice by registered email and in-Service notice. Continued use of the Service after the new version takes effect implies acceptance of the updated terms. If you do not agree, you may close your account before they come into force.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, including the Consumer Protection Code (Law No. 8,078/1990), the Marco Civil da Internet (Law No. 12,965/2014), and the LGPD (Law No. 13,709/2018). In consumer relations, the consumer's right to bring claims in the venue of their domicile (article 101, I, of the CDC) is preserved. For non-consumer relations, the parties elect the Courts of the Judicial District of Esteio, State of Rio Grande do Sul, Brazil, to the exclusion of any other, however privileged.
